Is Filing Bankruptcy Right for You?

To determine if filing for bankruptcy is the best solution for you, the best thing to do is speak with an experienced bankruptcy attorney. Here are some additional factors to consider before filing for bankruptcy:

Which Chapter of Bankruptcy Is Right for You?

The most common options are Chapter 7, Chapter 11, and Chapter 13.

Bankruptcy Eligibility

You should ensure that you are eligible to file for the type of bankruptcy you want.

Chapter 7 Bankruptcy: Eliminate Unsecured Debt

Chapter 7 bankruptcy, often called liquidation bankruptcy, is designed for individuals and certain businesses that cannot realistically repay their debts.

For many people, Chapter 7 offers the fastest path to a financial fresh start. Most cases are completed in approximately three to six months.

How Chapter 7 Works

When a Chapter 7 case is filed, a bankruptcy trustee reviews your assets and financial information. Property that is protected by applicable exemption laws is generally not available to creditors. If you own non-exempt property, the trustee may sell that property and distribute the proceeds to creditors.

Many Chapter 7 filers are able to keep all or most of their property because bankruptcy exemption laws protect essential assets.

Common Debts That May Be Discharged

Chapter 7 may eliminate many types of unsecured debt, including:

  • Credit card debt
  • Medical bills
  • Personal loans
  • Signature loans
  • Utility balances
  • Certain judgments
  • Deficiency balances after repossession

Not every debt can be discharged.  Certain obligations, such as child support, alimony, many recent tax debts, and most student loans, generally remain unless specific legal requirements are met.

Chapter 7 May Be Right for You If:

  • You have overwhelming unsecured debt.
  • Your income qualifies under the bankruptcy Means Test and the other applicable eligibility requirements.
  • You cannot realistically repay your creditors.
  • You need fast debt relief.

Talk with an our bankruptcy attorney to determine whether Chapter 7 is the right solution for your financial situation.

  • "If I ever need additional legal assistance, David McBride will be the first attorney I turn to."
David McBride is an excellent attorney. I cannot thank him enough for putting me at ease and for resolving my legal problems. On occasion when I needed to contact him and he was not available, his staff were amazingly helpful, and David promptly followed up with me even though his staff had already addressed my concerns. If I ever need additional legal assistance, David McBride will be the first attorney I turn to.

  • "Thank you, David and Jay for all that you did for us."
I highly recommend David McBride for his legal services. My family hired David for our first bankruptcy case. My Husband and I have been very, very satisfied. Not only does he possess immense patience and compassion, but is also very intelligent and well spoken. From the moment I spoke with him, I knew that he was there to look out for his clients' best interest rather than his own. I've heard my share of lawyer horror stories and have always been very cautious when approaching them. I am ecstatic that we were able to find a lawyer who is motivated by sound ethics, as they are often very difficult to come by. I highly recommend David McBride.  I also want to say a huge thank you to Jay, Mr. McBride's Legal Assistant. He helped to make sure that we had everything we needed and made sure that everything was taken care. Thank you, David and Jay for all that you did for us.

  • "I have had nothing but excellent experiences with the law firm of McBride & Associates."
I have had nothing but excellent experiences with the law firm of McBride & Associates. McBride & Associates has helped my family and extended family with many legal situations including estate planning, an auto accident, and dealing with prior creditors. I have known David McBride for years and he is very knowledgeable and not only a great attorney but someone who truly cares. I never would want anyone else representing me but David and his staff!
    - Darrell
  • "We cannot thank you enough, David McBride."
My wife and I have a "blended" family. We reached out to McBride and Associates to build an estate plan that would benefit our entire family and be "fair" to all parties...that sounds dry and hum-drum...but we wanted to be able to take out all of the drama and mystery of dividing up our estate after our (very much hopefully in the distant future) death. Their team put together a plan that works for everyone. We can not thank you enough, David McBride.

    • Will bankruptcy ruin my credit forever?

No. Although bankruptcy affects your credit history, many people begin rebuilding their credit shortly after receiving a discharge by responsibly managing new credit and maintaining timely payments. Suprisinly, some creditors look favorable upon people who have received a Discharge of their debts in Bankruptcy. This is because those persons have very little or not debt (other than the typical house and car debts, that most of us have). Those people often have money to spend – disposable income – for the first time in years. And those creditors take these facts into account when offering credit, including the fact that you cannot file another bankruptcy for eight years (at least when it comes to filing a subsequent Chapter 7 bankruptcy case, depending upon several factors).

    • Can bankruptcy stop foreclosure?

In many situations, filing bankruptcy immediately stops foreclosure proceedings through the automatic stay. Chapter 13 may also allow homeowners to catch up on missed mortgage payments (called the “Arrearage”) over time.

    • Can I keep my car?

Many individuals keep their vehicles, particularly when the equity is protected because applicable Oklahoma exemption laws or when they have chosen to keep a vehicle and continue making payments under the bankruptcy process. Often a person filing their case can get out from under a crushing car loan, return the vehicle, and Discharge the debt cleanly.

    • How much debt do I need before filing bankruptcy?

There is no minimum amount of debt required to file bankruptcy. The decision depends on your overall financial situation, your ability to repay your obligations, and your long-term financial goals. Our team will discuss with you all reasonable options to your current circumstances, and select the solution that best fits you and your family.
