Oklahoma’s Trust Law Changed in 2025
Oklahoma enacted the Oklahoma Uniform Trust Code (OUTC) through House Bill 1850, effective November 1, 2025. This legislation creates a new statutory framework alongside the existing Oklahoma Trust Act. Depending on the trust and its effective date, the OUTC may apply to some trusts while other provisions of Oklahoma law may continue to govern in certain circumstances, which is why it’s worth reviewing your specific trust’s terms and history.
Notification & Accounting Requirements Under the New Code
For trustees of irrevocable trusts governed by the new Code, specific notification requirements apply. Within 60 days of accepting a trusteeship, a trustee must notify beneficiaries of that acceptance and provide contact information. A trustee who learns that an irrevocable trust has been created, or that a revocable trust has become irrevocable, must also notify beneficiaries of the trust’s existence, the settlor’s identity, and their right to request a copy of the trust instrument. On the accounting side, the Code requires at least an annual accounting and a final accounting when the trust terminates, a requirement the trust’s own terms can’t waive. The Code further codifies duties already recognized under common law, including the duty of loyalty and the duty to treat multiple beneficiaries impartially.
These are general descriptions of the statutory framework. Whether and how they apply to a specific trust requires a closer look at that trust’s terms and circumstances.
Trust Administration vs. Probate for Oklahoma City Families
One of the primary advantages of a properly structured trust is that it generally avoids the probate process entirely. A trustee can exercise many powers granted by the trust’s own terms without seeking court authorization. Court involvement typically arises only when an interested party invokes the court’s jurisdiction, usually in connection with a dispute or a contested matter.
That said, trust disputes do reach the courts. In Oklahoma City, estate and trust matters are heard in the Oklahoma County District Court, which applies specific local procedures alongside state law. If a trust administration matter becomes contested, knowing that procedural landscape matters. We’re familiar with it.
